Terms of service

1. Acceptance

By downloading or using Mel, or by using our website, you agree to these Terms. Mel is in active development; features and terms may change with notice.

SMS/text messaging is optional and is governed by Section 5. Browsing this website, creating a Mel account, downloading Mel, or submitting a general contact request does NOT by itself constitute consent to receive SMS messages.

2. Use of the Mel terminal

Mel is a local terminal application. It runs commands on your machine; you are responsible for the commands you run and the files you modify. Mel provides the agent tooling; you supply the context and approve writes.

3. Use of the AI agent

Using the AI agent requires a Mel account. You may not share your account credentials or use the relay in an automated or abusive manner. We reserve the right to revoke access for violations.

4. No warranty; limitation of liability

Mel is provided "as is" without warranty of any kind. Use it at your own risk. Do not run it on production systems without understanding what commands it will execute.

To the maximum extent permitted by law, our liability for any claim arising from use of the software is limited to the amount you paid for it (which may be zero for the free terminal).

5. SMS / text messaging terms

Concepts Dzign LLC d/b/a Mel may offer optional SMS/text messaging programs.

A. Informational and customer-care program

Mel may send informational and service-related SMS to individuals who requested contact from Mel and provided express consent to receive text messages. Message content may include:

• lead follow-up
• consultation / demo scheduling
• onboarding coordination
• account-related communication
• customer care / support follow-up

B. How consent works

SMS consent is collected through a public website form or in-product flow that requires the user to actively select an unchecked checkbox. Consent language identifies Mel / Concepts Dzign LLC.

Consent is optional and is not a condition of:

• downloading Mel
• creating an account
• purchasing Mel services
• completing any transaction

C. Program disclosures

• Message frequency varies
• Message and data rates may apply based on your mobile carrier plan
• Reply STOP to cancel SMS messages
• Reply HELP for help, or email info@helloagentic.ai
• Supported opt-out keyword includes STOP (and related standard keywords processed by our messaging provider)
• Supported help keyword includes HELP
• Carriers are not liable for delayed or undelivered messages

D. Separate programs / no bundled marketing

Informational and service-related SMS consent is separate from any marketing or promotional SMS program. We will not use follow-up consent as consent for advertising texts. If a marketing program is offered later, it will require its own express consent.

E. Opt-out and recordkeeping

We honor opt-out requests. After you reply STOP, we will not send further SMS to that number for that program unless you later provide new consent. We retain consent and opt-out records as needed for compliance.

6. Privacy

Use of Mel and SMS programs is also governed by our Privacy Policy at https://www.openmel.dev/privacy.

7. Acceptable use

You agree not to misuse the website or messaging channels, submit unlawful content, interfere with operations, or use Mel to violate applicable laws or the rights of others.

8. Changes

We may update these Terms from time to time. Updates will be posted on this page. Continued use of Mel after notice of changes constitutes acceptance of the updated Terms. For SMS programs, material changes to messaging disclosures will be reflected on the opt-in flow and/or this page.
